Terms of Service

These Terms of Service ("Terms") govern your access to and use of websites and software products operated by OnStack Technologies ("OnStack", "we", "us"), including https://onstack.in and CreatorBay (https://creatorbay.app).

By accessing or using our services, you agree to these Terms. If you do not agree, do not use our services.

1. Company and products

OnStack Technologies is a software company based in India. CreatorBay is a product developed and operated by OnStack Technologies. Individual products may have additional terms presented at signup or within the product.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract to use our paid or account-based products. You represent that information you provide is accurate and that you will keep it up to date.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us promptly at support@onstack.in if you suspect unauthorized access.

4. Acceptable use

You agree not to:

• Use our services in violation of applicable laws or third-party platform policies (including Meta / Instagram policies where relevant)
• Attempt to gain unauthorized access to systems, accounts, or data
• Interfere with or disrupt the integrity or performance of our services
• Reverse engineer, scrape, or misuse our products except as permitted by law
• Use our products to send spam, harassment, or deceptive content

5. Third-party services

Our products may depend on third-party platforms and APIs. Your use of those platforms remains subject to their terms. We are not responsible for outages, policy changes, or limitations imposed by third parties.

6. Intellectual property

The OnStack name, product names, software, documentation, and website content are owned by OnStack Technologies or its licensors. These Terms do not grant you ownership of our intellectual property. You retain ownership of content you submit to our products, and grant us a limited license to process that content solely to provide the services.

7. Fees and billing

Certain products may require paid subscriptions. Pricing, billing cycles, and refund policies (if any) will be presented in the relevant product. Failure to pay may result in suspension or termination of access.

8. Disclaimers

Our websites and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

9. Limitation of liability

To the fullest extent permitted by law, OnStack Technologies will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of our services. Our aggregate liability for claims relating to the services will not exceed the amounts you paid us in the twelve months preceding the claim (or INR 5,000 if no fees were paid).

10. Termination

We may suspend or terminate access if you violate these Terms or if continued access would create legal, security, or operational risk. You may stop using our services at any time. Provisions that by their nature should survive termination will survive.

11. Changes

We may update these Terms periodically. Material changes will be reflected by updating the date on this page. Continued use after changes become effective constitutes acceptance.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply.
